Does an employee need to have worked for me for 26 weeks?
No. Since April 2024, requesting flexible working is a day-one right.
How long do I have to decide?
Two months from the request, including any appeal, unless you agree a longer period with the employee.
Can I refuse?
Yes, but only on one or more of the 8 statutory grounds and after consulting the employee. The Employment Rights Act 2025 is expected to add a reasonableness test in 2027.
